Terms of Service

Effective September 21, 2026

These Terms are a binding agreement between you and Xenia Group LLC, owner and operator of TruckER. By using gotrucker.app and related services, you agree to these Terms.

Accounts

You must be at least 18, provide accurate information, protect your credentials, and be authorized to act for any business account you use.

Marketplace Role

TruckER provides technology connecting drivers and fleets with independent commercial service vendors. TruckER generally does not perform towing, repair, tire, roadside, transportation, inspection, or emergency services. Vendors are responsible for services, personnel, licensing, insurance, pricing, taxes, workmanship, safety, and compliance.

No Emergency Service

TruckER is not 911, a medical provider, or an emergency dispatcher. Call 911 for immediate danger. Safety check-ins and alerts do not guarantee monitoring, response, rescue, or emergency assistance.

Service Requests and Payments

Users must provide accurate vehicle, location, contact, urgency, and problem information. Vendor offers, ETAs, availability, and estimates may change. TruckER does not guarantee provider response, arrival, completion, price, or results. Disclosed subscriptions, dispatch fees, and platform charges apply. Unless law or an express policy requires otherwise, platform and dispatch fees are nonrefundable after access or service is provided. Third-party processors may handle payments.

User Content and Conduct

You retain ownership of submitted content and grant TruckER permission to host, process, display, transmit, and use it to operate, secure, support, and improve the Platform. You may not submit false requests or records, misuse protected information, harass users, upload malware or unlawful content, bypass access controls, disrupt the Platform, scrape it without permission, or use another person’s account.

Vendor and Fleet Responsibilities

Vendors must maintain required licensing, insurance, equipment, qualifications, and personnel. Verification is not an endorsement or guarantee. Fleet administrators are responsible for members, permissions, vehicles, spending limits, approvals, and actions taken through authorized accounts.

Disclaimers

THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, XENIA GROUP LLC DISCLAIMS IMPLIED WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AVAILABILITY, ACCURACY, SAFETY, AND QUALITY.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, XENIA GROUP LLC AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, LOST PROFITS OR DATA, BUSINESS INTERRUPTION, VEHICLE OR CARGO LOSS, OR DAMAGES CAUSED BY THIRD-PARTY SERVICES. AGGREGATE PLATFORM LIABILITY WILL NOT EXCEED THE GREATER OF $100 OR PLATFORM FEES PAID TO US DURING THE SIX MONTHS BEFORE THE CLAIM. Limitations apply only where lawful.

Indemnification

You agree to defend and indemnify Xenia Group LLC and TruckER against claims and expenses arising from your services, content, conduct, breach, legal violations, or infringement of rights.

Termination

We may suspend or terminate access to protect users or the Platform, investigate violations, address nonpayment, comply with law, or enforce these Terms.

New York Law

New York law governs these Terms. Unless applicable law requires otherwise, disputes must be brought in state or federal courts located in Nassau County, New York.

Changes and Contact
